Rules of procedure of the Council of the University of Rostock
dated 4th November 2004

 

To fulfil its legally assigned tasks, the council adopts the following rules of procedure to itself:

§ 1 Executive Board

(1) The president and the vice-president preside the council. Until the election of the executive board, the oldest council member chairs the meeting. The president is responsible for the implementation of decisions. In case he/she cannot attend, the vice president will act in place of him/her. In case the vice president cannot act in place, the oldest member of the council will preside.
(2) President and vice president will be elected, each of them separately, from the council for a period of two years. Two re-elections are possible. Those persons are elected who get a majority among the present members.

§ 2 Induction

(1) The council is convened by its president, a preliminary agenda enclosed. The council has to meet at least once a year during semester period.
(2) The president has to convene a meeting upon decision of the Academic Senate. The same applies if at least one third of the council members or all representatives of one status group request convocation.
(3) The convocation of the council meeting has to take place two weeks prior to the meeting date latest. The resolutions proposed by the Academic Senate and the rector have to be enclosed.

§ 3 General public

The council meetings are open to university staff members. The president is entitled to invite persons who are not university employees.

§ 4 Applications

(1) Every member of the council is entitled to file applications to the board.
(2) Applications have to be submitted at least two days prior to the meeting date to the president of the council. The council decides on the acceptance for discussion after a short summary and justification of the relevant request by the applicant or, representatively, by the president.
(3) Amendments that derive from discussions during the council meeting can be submitted orally.

§ 5 Procedural motions

(1) Every council member is entitled to submit procedural motions. These procedural motions have to be worked on immediately. Procedural motions are signified by raising both hands.
(2) Procedural motions are in particular motions on:
- Postponement or interruption of meetings,
- Avoidance or postponement of an agenda item,
- Check for quorum,
- End of the discussion by interrupting the list of speakers and immediate quote on the relevant matter,
- Conclusion of the speakers list or limitation of the speaking time.

§ 6 Quorum and passing of resolution

(1) The presidents checks whether there is a quorum in the beginning of the meeting. A quorum of the council exists if a majority of the members is present. The council remains quorate until the absence of a quorum is stated by the president based on the application of a member.
(2) Resolutions are passed with the majority of the votes. An application is considered as accepted if there are more votes in favour than against.
(3) In case factual issues become subject of a vote, no further objective debates are possible. The same applies for the time after the vote.
(4) Decisions on all applications are made as open roll call unless one third of the council members or all representatives of one status group demand a ballot vote. Elections are secret ballots. All details are determined by the electoral rules.

§ 7 Electoral commission

The council appoints an election commission for managing the electoral procedure of an electoral commission over the relevant period of office. One representative of every status group should belongs to the electoral commission which elects one of their members as president.

§ 8 Minutes

Minutes of the council meetings are taken. The keeper of the minutes is not a member of the council. As a rule, the minutes have to be signed by the president. The minutes have to be served to the members of the council.

§ 9 Inception

These rules of procedure became effective with their adoption by the Council on the 4th November 2004.
