Legal foundations
The representative body for disabled employees of the University of Rostock represents the interest of all disabled employees of the university and those with an equivalent status towards their employer.
The ninth book of the Social Insurance Code (SGB IX) determines the legal requirements for a representative body for disabled employees, which can only be elected by disabled employees and those with an equivalent status.
The election and term in office of the representative body for disabled employees derives from §94 SGB IX.
"(1) At companies and offices where ate least five disabled persons are employed (temporary employments excluded), a person of trust and at least one deputy have to be elected, ..."
"(2) Entitled to vote are all disabled persons who work at this company or office."
"(3) Eligible are all employees of the company or office (temporary employments excluded) who have turned 18 prior to the day of election and who had been employed at this company or office for at least 6 months prior to the day of election; ..."
Regular elections have to take place every 4 years between the 1st October and the 30th November.
The tasks of a representative body for disabled employees are determined under §95 SGB IX, personal rights and obligations of the person of trust under §96 SGB IX.
